Terms governing your use of the Go 5tudio website.
Go 5tudio (operator: TMF; “we”, “us” or “our”) establishes these Website Terms of Use (the “Terms”) for the Go 5tudio website (the “Site”). Please review them before using the Site.
1. Application
- These Terms apply to everyone who accesses or uses the Site (“Users”).
- Users must comply with these Terms and applicable law.
- Additional conditions and notices shown on the Site form part of these Terms.
2. Relationship with individual agreements
- These Terms govern use of the Site and do not establish the detailed terms of production, development, design, consulting or other services.
- If we and a customer enter into a contract, order, quotation or other individual agreement, that agreement prevails in the event of inconsistency.
- Viewing the Site or requesting information, consultation or a quotation does not itself create a service contract.
3. Site content
- We endeavor to keep Site information accurate, complete, useful and current, but do not guarantee it.
- Articles, examples, figures and materials provide general information and are not professional advice or a guarantee of specific results.
- Results such as rankings, traffic, advertising performance, conversions and sales vary according to market, competition, budget, operations and technical conditions.
- Information may become outdated following changes in law, technology, services or markets.
4. Intellectual property
- Copyright, trademarks and other rights in text, images, video, audio, illustration, animation, 3D data, characters, designs, layouts, logos, diagrams, materials, programs and other Site content belong to us or the relevant rights holder.
- Except as permitted by law, content may not be copied, reproduced, modified, translated, distributed, sold, publicly transmitted or otherwise used without prior permission.
- Portfolio work may contain material owned by customers, creators, licensors or other third parties. Publication does not transfer or license any rights to Users.
- Our name, brand and logo require prior permission for use.
5. Quotation and links
- Ordinary links to public pages are generally permitted.
- Quotations must comply with copyright and other applicable laws and clearly identify the source.
- Links are prohibited where they are unlawful, misleading, defamatory, imply an unauthorized relationship, obscure the source through framing, directly target media files, or use our name or logo without permission.
- We may request that an inappropriate link be changed or removed.
6. Prohibited conduct
Users must not:
- Violate law, public order, or the rights or interests of us or others
- Submit false information or impersonate another person
- Attempt unauthorized access, analysis, alteration, interference or security circumvention
- Transmit malware or place excessive load on systems or networks
- Use automated means to improperly or excessively collect or reproduce Site content
- Use contact channels for indiscriminate or repeated sales, advertising, solicitation or nuisance messages
- Otherwise interfere with the proper operation of the Site
7. Enquiries and submitted information
- Users must hold the rights and authority necessary for information they submit.
- An enquiry, consultation, material request or quotation request does not oblige us to accept work, make a proposal, respond or enter into a contract.
- Submitting information through ordinary contact channels does not create a confidentiality agreement. Please consult us before sending trade secrets or other highly confidential information.
- Personal data is handled under our Privacy Policy.
8. External websites and services
Third-party websites and services are governed by their own terms and privacy policies. We do not guarantee their content, accuracy, security or availability.
9. Changes, suspension or termination
We may change, suspend or discontinue all or part of the Site when reasonably necessary, including for maintenance, system failure, security, force majeure, legal requirements or operational reasons.
10. Disclaimers and limitation of liability
- We do not guarantee the Site’s accuracy, completeness, usefulness, currency, security, fitness for a particular purpose or uninterrupted availability.
- Users rely on Site information at their own judgment and responsibility.
- Where we are legally liable for loss related to the Site, liability is governed by applicable law. Except in cases of intent or gross negligence, liability is limited, to the extent permitted by law, to ordinary and direct loss actually incurred.
- Nothing in these Terms excludes protections that cannot lawfully be excluded, including under Japan’s Consumer Contract Act.
11. Personal data
We handle personal data and other user information under our Privacy Policy.
12. Changes to these Terms
We may revise these Terms in accordance with applicable law where a change benefits Users generally or is reasonable in light of its necessity, appropriateness and surrounding circumstances. We will announce the change and effective date by an appropriate method.
13. Governing law and jurisdiction
- These Terms and use of the Site are governed by and construed under the laws of Japan.
- Unless otherwise required by law, the Tokyo District Court or Tokyo Summary Court has exclusive agreed jurisdiction in the first instance over disputes relating to these Terms or the Site.
